The Securezone VPN service enables users to choose their virtual location by routing their Internet traffic through a virtual private network. The Service is offered by Securezone Team.

Privilege & Registration

The utilization of the Service is restricted to parties that can legally enter into and form contracts under applicable law. Every person who uses the Services hereby represents to the application that he or she is more than 18 years of age and is fully able and authorized to enter into the terms, provisions, necessities, affirmations, representations, and warranties set forth in this Agreement and to abide by and comply with the terms of this Agreement. If You are under 18 years of age, please do not use the Services.

Service Description

The Service is a virtual private network communications service that contains software, that interacts with Our servers (or third-party contractors' servers) which allow You to create a virtual private connection. The Software on Your Device connects to a server network infrastructure that is deployed on the internet and operated as a managed service by Us and other service providers. All or some of the Service ensured hereunder may be provided by a third-party provider.

Impersonal Information Securezone collects and How We Use It:

You will have specific rights to use the Software and reach the Service during the Service Period. The “Service Period” shall begin on either the date of purchase of the Service, if You purchased a subscription for the Service online, or on the date You activate the Service, if You acquired the Service through other means (for example, if You are activating a free or trial version of the Service), and shall continue for the period of time set forth in the Service documentation.

About Service and Software

Besides, all materials included with the Software and Service, including all trademarks, service marks, and trade names are the property of the application and its third-party licensors. You do not obtain any rights, express or implied, in the Software and Service, other than those specified in this Agreement. To the extent permissible by applicable law, You may not, nor may You allow any other person or entity to:

  • redeliver or lease any portion of the Service or the Software;
  • reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of the Software or create derivative works from the Software or Service; or
  • reproduce, replicate, copy, sell, trade, resell or exploit for any commercial aims, any portion or use of, or access to, the Software or Service; or
  • copy, reproduce, capture, store, retransmit, distribute, or burn to CD (or any other format or device) any copyrighted content that You access or receive while using the Software or Service. You assume all risk and liability for any such prohibition use of copyrighted material.
Acceptable Use

You are and will be solely liable for Your conduct related to the Service. You specifically admit that You shall abide by and cooperate with Us to enforce and/or prevent potential violations of the Digital Millennium Copyright Act and any other similar statutes to which You are subject, such as in the European Union the national implementations of Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonization of certain viewpoints of copyright and related rights in the information society. In the United Kingdom these are included in the Copyright, Designs and Patents Act 1988. You further agree that You will not use the Service:

  • in violation of any practicable laws or regulations, or to support the violation of any applicable laws or regulations;

  • to upload, post, or otherwise transfer any content that contains viruses or other harmful computer code or files such as Trojan horse, worms, time bombs, or the like;
  • to upload, post, or otherwise transfer any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes” or any other form of solicitation;
  • Illegal or unauthorized access to other computers, mobile devices or networks;
  • use of torrents for illegal downloads;
  • to attempt to gain unauthorized access to the Service, the accounts of other Service users, or mobile systems or networks connected to the Service; or to otherwise interrupt or disrupt the Service or servers or networks connected to the Service
  • delete the copyright or other proprietary rights on the Software or Service;
  • use the Service or Software for any commercial use without the prior written approval of Us, it being understood that unless specifically provided otherwise in the respective Service documentation, the Software and Service are for personal, non-commercial use only; • use the Software or Service if You are under the age of 18 years old;
  • remove, circumvent, disable, damage or otherwise interfere with security-related features of the Software or Service, features that hinder or restrict use or copying of the Software, or features that enforce limitations on the use of the Service;
  • reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Service or Software or any part thereof, except and only to the extent that such activity is expressly allowed by applicable law still this limitation; or
  • modify, adapt, translate or create derivative works based upon the Software or Service or any part thereof, except and only to the extent prior restriction is expressly forbid by applicable law. You understand that, still Our efforts and the terms contained in this Agreement, you may be exposed to content which You find to be offensive, inappropriate or undesirable when using the Service, and, accordingly, You use the Service at Your own risk of being exposed to such content.
Amendments to the Service; Amendments to Terms of Service

You shall have the right to receive new properties to the Software and Service. We frequently endeavor to improve the utilizability and performance of its products and services. In order to optimize the Software and Service we may, at discretion: add, modify or remove features of the Software and Services, or temporarily limit the use of the Software and Services or limit its availability in order to perform maintenance activities, at any time with or without notice to You. We may also update the terms of this Agreement and recommend that You check the terms of this Agreement regularly to see if they’ve been updated. We will post modifications on www.securezonevpn.app (or such other URL that we may provide from time to time). You agree that You will be considered to have been given notice of any modifications once we post them to www.securezonevpn.app. Your continued use of the Service will be esteemed to be Your compliance of the updated terms of this Agreement.

Rescission and Suspension

Your right to use the Service shall terminate upon expiration of the Service Period. In addition, We may, at discretion, immediately suspend or terminate Your use of the Service at any time with or without notice to You if You violate, or we reasonably believe that You have violated, the terms of this Agreement, or if Your use of the Service may cause Us to have legal liability or disrupt others’ use of the Service (in which case no refund shall be made).

Without violating from the above, We reserve the right to discontinue the Service or to alter the content of the Service in any way and at any time, with or without notice to You, without liability.

Fees

You approve that We reserve the right to create a subscription service through one or more third party tradespeople. Payments will be charged on the day you purchase a subscription and will contain use of that service for the duration of one (1) week, one (1) month, one (1) year, or any other period depending on the service plan level. A subscription plan is an automatic payment repeated based on the service plan. All accounts are offered as is at the time of purchase. You may cancel the account subscription at any time; the account will remain active for the remainder of your billing cycle. If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

The company reserves the right to modify the fees at any time at its tolerance. Subscriber understands that We are not obligated to honor errors due to typos and is not in charge for misinformation provided on third party websites or affiliates.

Privacy; Data Protection

Your privacy is important for Us. When You set up a Securezone VPN, we may collect information from You as described in the Privacy Policy.

Copyright and Trademark and Proprietary Rights

Copyright in materials and graphical elements on the Services and VPN App containing site design, text, code, graphics, interfaces, and the selection and arrangements thereof, are owned by Us or a third party. The reproduction and redistribution of any of these written and/or graphical elements is forbidden.

You acknowledge and accept that the Services and any necessary software used in connection with the Services include proprietary and confidential information that is guarded by applicable intellectual property and other laws and treaties. Except as expressly authorized by Us, you accept not to change, rent, lease, lend, sell, distribute or create derived works based on any content found and/or accessible through the Services.

You also accept that you will not use, copy, imitate, or incorporate any copyrighted materials, trademarks, service marks, company names, patents, or product names in a way that is likely to cause confusion in the public. You also accept not to remove, obscure, or change Our or any third party’s copyright notice trademarks, or other proprietary rights notices adjoint to or contained within or accessed in conjunction with or through the Services.

The Service and its original content, features and functionality are and will remain the exclusive property of Securezone VPN and its licensors. The Service is protected by copyright, trademark, and other laws of both the France and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Securezone VPN.

THE SERVICE (INCLUDING THE VPN APPS) IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. SECUREZONE, ITS AFFILIATES, AND THEIR RESPECTIVE SUPPLIERS DENY ALL WARRANTIES WITH REGARD TO THE SERVICE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR AIMS, TITLE, AND NON-INFRINGEMENT. SECUREZONE DOES NOT REPRESENT OR WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, THAT FAULT THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFULS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS COMPONENTS. SECUREZONE DOES NOT WARRANT OR REPRESENT THAT THE USE OR THE RESULTS OF THE USE OF THE SERVICE OR THE MATERIALS MADE AVAILABLE ON OR REACHABLE THROUGH THE SERVICE WILL BE CORRECT, ACCURATE, TIMELY, OR OTHERWISE CONFIDENTIAL. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICE, OR WITH ANY OF THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO CUT USING THE SERVICE.

LIABILITY

IN NO EVENT SHALL SECUREZONE TEAM, ITS AFFILIATES, OR THEIR RESPECTIVE SUPPLIERS BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, PUNITIVE, ACCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INVOLVING, WITHOUT RESTRICTION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICE, WITH THE DELAY OR INADEQUACY TO USE THE SERVICE, THE PROVISION OF OR FAILURE TO ENSURE SERVICE, OR FOR ANY CONTENT ACQUIRED THROUGH THE SERVICE, OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICE, WHETHER BASED ON CONTRACT, INJUSTICE, OMISSION, STRICT LIABILITY, OR OTHERWISE, EVEN IF SECUREZONE TEAM, ITS AFFILIATES OR ANY OF THEIR RESPECTIVE SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Law

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Indemnification

You accept to indemnify and hold harmless the Securezone Team, its affiliates and its and their respective directors, officers, shareholders, employees, agents, successors and assigns from and in return for any and all losses, claims, liabilities, damages, demands, costs and expenses (including reasonable attorneys' fees and fees of investigation), arising out of, or interrelating to, Your use of the Service, Your violation of this Agreement, including Your breach of any covenant, representation, warranty, term or situation set forth herein, and Your violation of any law or regulation or of any third party's rights, containing any third party's intellectual property rights.

Export Regulation

You approve that the Software and related technical data and services (collectively "Controlled Technology") is subject to the import and export laws of the United States, namely the U.S. Export Administration Regulations ("EAR"), and the laws of any country where Controlled Technology is imported or re-exported. You agree to comply with all relevant laws and will not export any Controlled Technology in contravention to U.S. law nor to any forbidden country, entity, or person for which an export license or other governmental approvals required. All Our products are forbidden for export or re-export to any country subject to relevant trade sanctions. USE OR FACILITATION OF OUR PRODUCTS IN RELATION WITH ANY ACTIVITY INCLUDING, BUT NOT LIMITED TO, THE DESIGN, DEVELOPMENT, FABRICATION, TRAINING, OR TESTING OF CHEMICAL, BIOLOGICAL, OR NUCLEAR MATERIALS, OR MISSILES, DRONES, OR SPACE LAUNCH VEHICLES CAPABLE OF DELIVERING WEAPONS OF MASS DESTRUCTION IS FORBIDDEN, IN ACCORDANCE WITH APPLICABLE LAW.

Legal Effect

This Agreement identify certain legal rights. You might have other rights under the laws of Your state or country. This Agreement does not change Your rights or obligations under the laws of Your state or country if the laws of Your state or country do not allow it to do so.
